I received an alias summons for defaulting on a car loan. I have the same first and last name but the debt is not mine. I have called the debt collection agency and informed them but they want a copy of my drivers license. I am reluctant to give them personal information. I am in a different state and have clear evidence that I am not that person. For example, I have lived at my current address for 10 years prior to the debt being issued.

I have an auto loan that is being charged off. The principal balance of the loan has been paid off for about a year. I have been paying insurance money that the bank purchased about 2 years into the loan because I failed to show proof of full coverage. I have fallen on difficult times due to my wife losing her job, and have been unable to make the payments. The accout is about 6 months past due. My question is can the repossess the vehicle even though the principal balance has been paid, and what happens when an account is charged off.

Hi,

In 2012 and early 2013 I had some life circumstances that resulted in me getting behind in my credit card payments (late payments) and eventually I was unable to pay my 2 bank credit card bills which were then send to collection agencies.

I ended up paying a portion of the amount owing and the account was settled and closed, along with the bank account attached to it.

1st credit card settled and closed mid 2012.

2nd credit card settled and closed end of Dec 2012 but not reported as such until Feb 2013.

Can I take action in court against this lawyer?

The plaintiff couldn't reach me in 2006 to serve me a complaint on note. I was served an alias summons about 8 years later. ABOUT 16 days later a lawyer called up . Said he represents credit union. He asked me to verify I owed the credit union. He asked how much I could pay. How much I made. When I said 100$ he complained that its not enough. He then said i should agree to a judgement and said its good because it will lower the interest rate. He asked me several times to consider agreeing to judgement. When I said no he said hes going to persue a judgement anyway.
