After reading many of the posts here I decided to contact one of the collection agencies listed on my credit report so that I could pay it off. I contacted them by telephone and was told by the collection person that they no longer had my account. Should I send the debt validation letter with an offer for payment of deletion or just the plain demand for validation? I can pay the money...I just want to make sure it comes off my credit report. The said I should contact the original creditor, Sprint. I don't want to open too many cans if I don't have to..Advice?
Bntru2me,
Send a DV letter to each CA that had a listing on your CR. That way you can get the marks of the comapnys that no longer own the debt off your CR. Now, once the CA that OWNS the debt contacts you start your PFD offers. Do all of your talking through the mail and basically make the PFD offer the path of least resistance for the CA. Most times this will work in your favor. If not keep disputing the listing and sending DV letters and PFD offers to the CA until they either see it your way, the SOL expires or they sue you. Now, remember that if the SOL hasnt expired they can sue you. Honestly, this isnt the worst thing that can happen if you have some cash on hand. Basically, if they so sue you (and they are right) they probably arnt the PFD kind of company. Now if you pay them before the answer date the lawsuit will not go on your CR. I highly doubt things will get that far. I just wanted to make sure you knew it could happen.
Hi Bntru2me
You can send DV letters to each of the CAs but sent PFD agreement letters only to those CAs who validates your debt and try to come to a repayment plan with those who validates the debt. But don't agree to a repayment plan you think you cannot afford to pay. Get everything in writing as CMBV pointed out. For those who cannot validate your debt or for those as you mentioned no longer has your account with them, you can send a dispute letter to the CRAs asking them to delete those listings.
