"Charge-off" generally stays in the credit report for 7 years from the day you became delinquent. If the 7 years time period is over, "charge-off" should fall off from the credit report. I believe you intend to sue the collection agency for not reporting to the credit bureaus, to update your credit report. For this you have to send them a letter through certified mail with a return receipt requested. Pls. Help! I opened an account w capital one in '05. I lost my job shortly after so I couldn't pay my balance of $900. About 3 years ago I moved to Washington state from California. After doing some research I found out that they hired lawyers and they got a judgment against me in California!!! I checked online w the court in Cali and it said that capital one and theyre lawyers sent various certified mail papers for me to show up to court! But they were sent to the address that I hadn't in for years! Plssss help! What can I do? Should I fly down to Cali? Get a lawyer?
There's no need to get so tensed about this. First can you tell whether or not you sent notice to the card company about the change in address? Well, as you were not properly served in regards to the judgment, you can file the motion to vacate this judgment.

"Charge-off" generally stays in the credit report for 7 years from the day you became delinquent. If the 7 years time period is over, "charge-off" should fall off from the credit report. I believe you intend to sue the collection agency for not reporting to the credit bureaus, to update your credit report. For this you have to send them a letter through certified mail with a return receipt requested. Please find a sample of a Intent to Sue Letter in the following link: http://www.creditmagic.org/sample-letter/sue-collection-agency.html . Please enclose copies of the bank statements that prove you have already paid off the debt.

Pls. Help! I opened an account w capital one in '05. I lost my job shortly after so I couldn't pay my balance of $900. About 3 years ago I moved to Washington state from California. Two weeks ago i checked my credit because I was trying to buy a house and and was not approved because capital one was been keeping my credit up w notices and bad remarks. After doing some research I found out that they hired lawyers and they got a judgment against me in California!!! I checked online w the court in Cali and it said that capital one and theyre lawyers sent various certified mail papers for me to show up to court! But they were sent to the address that I hadn't in for years! Plssss help! What can I do? Should I fly down to Cali? Get a lawyer?
