Hello.

I have a charged off debt from '05 on my. It is listed on my credit report. I received a collections notice (planning to send DV letter) from NCO. I checked my credit report and it is ALSO listed by NCO. Is that LEGAL? How can a debt be reported twice?

Since you have already received a collection notice from the creditor, you should immediately send a debt validation letter within 30 days from the date of receipt of the collection letter, else the debt would be considered as valid.
A debt cannot be reported twice but both the original creditor and the collection agency can report the same debt on your credit report.

I voluntary surrender a car in 1998 it was in my credit till 2005. Has not shown in my credit for the past 3 years. Know i received a collection notice from NCO saying I owe them and that if i don't respond they will put me in collections. could a debt that has been in my credit report for 7 years and taken off be put back again?

Hi Matty,

When you voluntarily surrendered your car, it is most likely your creditor sold it off to recover the debts you owed. So it not possible to start collection action for the same debt once again, as it is already paid off.

could a debt that has been in my credit report for 7 years and taken off be put back again?

If the same debt accounts reappear on your credit report you should send a "Dispute Letter" to the credit bureaus. You must also enclose copies of all written documents, supporting your viewpoint

Good luck to you.

Hi Matty,

When your car was sold off, did you confirm that the debt was paid in full? Maybe NCO is trying to collect any remaining balance that you still owe. If you ask for a debt-validation you will come to know, whether you actually owe any bucks to them.

hi. i had a credit card that was placed in collection in 1996 and, after 7 years, fell off said credit report. it has been clear since then. yesterday, i recieved a letter that the same debt was in collection and , if i refuse to pay it will be placed on my credit report again. is this even legal? thanks for all you can tell me.

this is not legal. so unless this is a judgement there is no way it will be legally put on your report Send a DV and send a copy to your attorney general. Threatening action that is not available to them is a violation and you may be able to sue them.
