Hi Everyone,
I sent a pay for delete letter certified mail about a month ago and received no response. What is the next step? I offered to pay the amount in full (it is only $191) for delete. I did not request a DV because it has been over 30 days since I was notified of the debt..... at least, I think. I actually do not even know if or when they contacted me about it. In the past, when I received letters from CA's I just threw them away. And I do not answer their calls. Is it really too late to request a DV?
hi openyourize

First find out if you are within the 30 days window. If yes, then ask for debt validation.

This is a great mistake many of you make. The worst thing you could do with a debt is to ignore it. Your debt might not be so bad but you make it difficult to handle by ignoring them and by avoiding a solution. Don't wait till your debts get irreparable or till they cause a lot of damage.
Check your papers properly and see if you can seek debt validation. Don't assume anything.
I to agree but Carol what if the debt is past the SOL. I have an old one past 7 years old that has fallen off my credit report (friend used my book to order items and even though she had it shipped to her address I could not get them to delete the bill even after explaining I had given her no permission). Every time I send a cease and desist they just sell it and it starts all over. In this instance I just believe it is easier to not have contact or you just start the process all over again.
Open, maybe you should pick up the phone when they call or even call them if you are willing to pay this debt. Maybe with a little persistance they would agree to a PFD. You could be avoiding a phone call concerning the PFD if you are not picking up.
Well Firey
If the SOL has expired, you are the one who is aware of it but the court isn't. So you need to appear before court and explain that the SOL on your debt has expired.
About the credit agencies, they sell off debts past the SOL to agencies who are bulk collectors of debt. Some agencies still pester individuals for repayment because a lot of individuals are not aware of their rights and would probably pay it off because they feel intimidated.
Carol, I use to request validation but with the debt being so old usually they just sell it as soon as I ask. I use to pick up the phone but when I tell them that this was originaly not my debt and that it is past SOL they hang up. I started sending cease and desist but it goes to the same thing..they sell it.
I tried years ago to get this debt resolved with the original creditor showing them the documents of where the items from the catalog was shipped and told them I had no knowledge of the order until I was contacted by them for payment. They were suppose to look into it and contact the other person whom took the book. Low and behold they just sold it and now it lingers there. I disputed and everything but never got anywhere. Thanks for replying.
Hi firey
Try to dispute the debt with the bureaus. It will become their responsibility to ask the creditors for validation and if it is a misrepresentation, the information will get removed from your records.
I will give this a try. Thanks for your help. I have not tried anything in a while but maybe now is the time.
