My wife and I each pay about half of the bill's each. She went out and charged 9 credit cards in HER name only. She just told me that she hasn't made a payment on ANY of them for 4 or 5 months.Even with the little bit of my money I have left over at the end of the month, I can't help her pay them back. Since they are in HER name only, Am I responsible too. She is not on my checking acct. Is it legal for her to pay ME for her half of the bills ? We live in Colorado. Thank you so much - Richard
First of all, you are not liable to pay back your wife's outstanding bills as long as the credit accounts are in HER name ONLY. However, in case of a joint account, then you'll be asked to pay up too and on a default, your checking account may get garnished by the creditors, provided they win a judgment against you.
Sorry to hear the circumstances Richard. Best bet for her is to send a validation request once the accounts have been moved to collections. By doing so, she'll be able to accurately combat the possible hard-ball tactics used by the collection companies. By using lifecreditdebt I was able to not only get my wife's delinquent debt removed for our joint-accounts but I was also able to ensure that the creditors were abiding by the FCRA and FDCPA standards. We all have rights, we just need the knowledge to be able to use them correctly. Best of luck!
