I only filed because I got hit with a garnishment from a debt from 17 years ago (it was legal on their part.) The debt was 9k and grew to 22k with interest an penalties.. I get a letter from my employer letting me know I will have $400 a paycheck ($800 a mo) taking out for this debt which would have prevented my from basically living and paying my other current debts so I had no choice to file BK.
At the time of the BK I had 4 or 5 major CC's with about 12k in debt and 2 personal loans worth another 14k that I was paying on and was NEVER late... I had PERFECT credit when I filed BK and my FICA was 752.
I then filed in August 2012 and it was Discharged in November of 2012 and during those 3 months from when I filed until it was Discharged, a couple of my creditors reported 30 days late then 90 days late then 120 days late, then stopped when it was Discharged...
Do you think those 3 month entries showing me as late are incorrect and something I can removed?
Sorry if that was long-winded, tried to be a concise as possible and thought a little back story would help...=))
Perfect credit and have a question?
Welcome to the forums!!!
Usually negative items remain on your credit report for 7 years from the date of your first default. As you have filed bankruptcy, so it will remain on your credit report for 10 years from the date of filing. I think it would be better for you to consult with a bankruptcy attorney in this regard.
It's not possible to decide whether they're incorrect. You should take legal help for that and if you can establish that they're truly incorrect, then surely they can be removed.
If they reported the late payments within the time frame of filing the bankruptcy and getting the discharge, then you can dispute the listings with your credit bureau. They actually aren't supposed to report when the automatic stay comes into effect!!!
