I have defaulted on a credit card. The account has gone to collections. I don’t have money to pay off the debt. The collection agency calls me every week. The collection agency has even started calling my friends and relatives. I have told the collector that he is breaking the FDCPA law. The collector told me that since I have defaulted on the debt. So, I don’t fall under the FDCPA laws. I don’t have any right. Is it really so?
Breaking the FDCPA law
Welcome to the forums!!!
Since the CA has disclosed the information with your friends and relatives, so they have violated the FDCPA laws. File a complaint against them to the SAG or FTC immediately.
Also, when you file the complaint or write your letter to them, keep it so that you can use it in the future. It has been my experience that once you get the upper hand on them that they will sell it off and the crap starts all over again. I have them on my computer for one particular debt that just continues to be sold even though it is no longer on my credit report, they continue to try and collect.
