Wage garnishment - What is it and how can you stop it?

If you're unable to pay your debts on time, your creditors or collection agency may file a lawsuit and win a judgment against you. Then, if wage garnishment is legal in your state, creditor or collection agency (CA) may have the judgment enforced through a wage garnishment. A wage garnishment is where the creditor or CA contacts your employer and requires him to withhold up to 25% of your wages to satisfy the judgment, depending on your state's law.

How can you stop wage garnishment?

Once a wage garnishment order has been granted, it is difficult to reverse it, but not impossible. If you can't manage to pay your basic living expenses while your wages are garnished, then you should collect a "Claim of Exemption" form from your local courthouse and file it with the court that issued the garnishment order. You should also request a court hearing and object to the garnishment to explain your situation in detail. On the day of the hearing, you'll need to show documents regarding your income and expenses so you can convince the judge that the garnishment will adversely affect your financial situation.

If you don't contest or fail to contest the garnishment, you can either pay off the judgment amount in full or negotiate a reduced payment with the court. If your state's garnishment law imposes a lower garnishment amount, then the court will follow the state law when imposing a garnishment order.

While your wages are garnished to satisfy the judgment, a lien is placed on your assets and property and it'll remain until you pay off the judgment amount. If you sell your property, the sale proceeds will be applied first toward the judgment and then toward any other debt.

In some states like Michigan, a garnishment order expires after 3 months. Therefore, a creditor or collection agency needs to obtain a new order for garnishment 3 months after the first order has been issued. This gives you some more time to work out a payment plan with your creditors/CA or challenge the amount being garnished.

What's the best way to avoid garnishment?

If you think your creditor or collection agency is taking steps to have your wages garnished, the best way to avoid it is offer a payment plan you can afford.

The best way to avoid a wage garnishment that you can't afford, after you've been served, is to answer the complaint within your state's time limit and appear in court on the appointed day. This way you will be able to present your case to the judge before the judgment is issued. You will also be able to present the judge with a statement of your finances that will help the judge determine how much the creditor or collection agency may garnish.

You can also try to negotiate with the creditor or collection agency before judgment is granted and get them to agree to an installment plan. Dealing with the creditor, collection agency, and the court before the judgment is granted is easier and more cost efficient than attempting to appeal one.

What if the IRS files wage garnishment?

If the IRS has a wage garnishment order issued against you, contact them within 30 days of receiving the Notice of Intent to Levy, and come to an arrangement with them to prevent your wages being garnished. You can try for any of the options stated below to stop wage garnishment being enforced on you:

  • Pay the debt in full: Here, you pay off the entire amount you owe including the interest and the penalties you've incurred. If you don't have enough funds, consider borrowing from your family or selling your assets to pay off your tax debt. If you don't find this option suitable, try settling your tax debt with the IRS.

  • Offer in Compromise to settle taxes: Under this agreement, the IRS agrees to accept a payment less than what you owe on your taxes.

  • Installment agreement: This is where you agree to pay off your tax debt in monthly installments over a 3 year period. If you owe $25,000 or less in taxes including your interest and penalties, you can apply for an installment agreement online. However, if your tax debt exceeds $25,000, you need to fill out a Collection Information Statement, Form 433F, and mail it to the address stated on your tax bill, along with the Request for Installment Agreement, Form 9465.

i collection agancy is garnishing my wages for a credit card from the 90s. summons was delivered to some one they claim was my husband 60 yrs old (never been married) and was 30 around that time in 2004. their attorney said they can offer a abeyance letter to stop garnishment if i agree to make a payment arrangement. Can my employer freeze the garnishment with this abeyance letter without order from the court?

I STARTED RECEIVEING MY PAY 8 YEARS BEFORE I WAS MARRIED. MARRIED 7 YEARS. IT IS MY UNDERSTANDING THAT THIS SHOULD HAVE BEEN IN THE DIVORCE DECREE INORDER FOR THIS TO HAPPEN. This past 3 to 4 months I have been getting phone calls from several collection agencies about some school loans that I do owe since 1987.I have tried to work things out and I thought I did but they have never sent me anything in the mail. This last July 1st they garnished 153.90 out of my Social Security Disability payment that is my only income. I found this out at the Social Security office and also found out that all information was sent to an old address of over 16 years. Since then we have worked out that I pay 60.00 per month plus the 153.90 for the first two months because they said that it takes at least two months to stop a garnishment. I still have not received anything though the mail even though they keep telling me that it's been sent, and I still keep getting phone calls even on Sundays and every hour of the day. What do I do?

I have been paying a garnishmet for over. 2 yrs. Now and thought. I was almost. Done then they told me I still owe $6000 more dollars after I have already paid almost $13000 and was told when this starts I could pay $9000some odd dollars and be done. At this rate I will never get it paid is there anything else I can do Tp stop this?

can it be stopped. I owed at one time less than 1200.00 to a credit care. It is two years old. I had health problems and failed to contact them. I now am being garnished for 3000.00. 20 % of my earnings till paid off. anything I can do?

I am prior navy and when I was discharged they overpaid me and I did not know they did. About 7 months ago they set a garnishment and took my tax return. The debt was a little over 900 dollars, my tax return was 695 and they have garnished over 400 dollars and I can't seem to find the paperwork mailed since we recently moved I would like to know how to get this garnishment stopped I've been to several websites asking this question and nobody responds I'm hoping for some way to get them to stop the garnishment and return how much they over garnished.

I went to a small hearing where my old landlord sueing me for damages to her house when some of the damages were alreday there when I moved in so basically she lied about everything and she won her case. Now they are going to garnish my check when I can't afford it. I will loose everything including my home. My check is enough to pay my bills.

I have a court hearing for exectiom and to answer interrogatories and they want to ask for garnishment on my wages I had set up a payment plan with the lawyer who representative. For the hospital who is suing me I agreed to make a payment in a certain amount they told me it was not acceptable. So I tried to pay a larger amount I could no longer afford to pay that amount my checking AC account. Is overdrawn from my car insurance student loan and other bills and what I was trying. To pay them it has not been right since I tried to pay them and other creditors it is still overdrawn trying to pay other expensive what can I do can o file for a slow pay PR any other motion in writing

Already had a garnishment taken on me and they said if all wasn't paid by sept 6 th they can refile, well they took out 205 more on Sept 14 and oct 12th and had refilled stating I owe 284 the total amount was 677$. When they took 205 i only owed 12.77. How can they refile if they took more money out after the 6th and still say I owe 285? Can they do that and what action can I take?

I have been having my wages garnisher for upwards of 5 years now. The ammount I owed at time of the hearing was aprox. $11,000, over the course of those 5 years I have payed $12,150 (aprox). I still owe the debt collecter $13,000(aprox.). How is it legal to inpose 21% intrest on a garnishment. I will never be able to pay them off. They offered me a "lowered pay off" last year of $9,500 if I had that kind of money laying around do you think I would be in the situation im in? What can I do legaly?

I had a car repoed in 2001. the company filed for amount they said i owed. They are still taking money from my pay now. How can they keep stopping and starting all the time. They have not tried to call me or anything. I am tired of all this and want it to end! Is there anyway to do this except file bankruptsy?

I have been fighting this company for over 10 years. I have sent them statute of limitations letters and requested proof that I owe the money, which they never sent. They are still garnishing my wages with I have never been served paperwork on. I know all of this is illegal and I have contacted lawyers and they agree that it is illegal but they say they can't help me. Is there anything I can do to stop this. I just lost my job and am working temp jobs at over $100.00 less pay I can't afford this garnishment, when I can barely afford my bills now, I'm behind on everything since I lost my job.

Hi my husband is head of household (Oregon) and is the only earned income and we are low income. my question we have been garnished for 4 weeks once a week and we just found out. we requested the paper wk from his employer (Kroger foods) and they just gave it to us. it started a month ago. we had no idea it was happening, and the paper wk is dated march of 2011. my spouse has been out of work for almost 2 yrs and finally got a low paying Job and we get hit with this not ever being told by anyone. the paper does not even say on it who the creditor is? since it's over a year old can I still file a exemption form with the court?

My son whobis now 19, got into trouble as a juvenile and put on probation. His last judge finally took him off probation and waived all court costs and fines. My wages are being garnished for the probation costs. It's California state tax franchise garnishing me. How can I stop this and get it withdrawn? Hi Carol! my wages are being garnished by an attorney who never filed a lawsuit against me. Can they legally do that? According the district clerk, there was a lawsuit filed initially by another law firm who is no longer in business. I had no knowledge that any lawsuit was ever filed against until today November 8, 2012. According to the clerk, default judgment was entered in September 2007 and my wages are just now feeling the effects of the garnishment. Can
one lawyer obtain a stale debt from another lawyer and garnish my wages without my knowledge of ever knowing that a lawsuit was ever filed against me? Two different lawyers, two different law firms, same creditor, and know knowledge of a lawsuit ever filed. I welcome your professional opinion on the matter.

my husband has had some issues with his health for years now. has had to undergo surgeries which the insurance he had was supposed to cover. after everything was said and done they refused to pay any of it. we tried to talk to them and the doctors and still nothing. we owe thousands of dollars that we just can't afford. they took us to court about 3 years ago and set an amount to pay each month but we tried to tell them we could not do that much. we were at a really bad financial state and honestly didn't even know if we were going to have enough to eat. since then they tried to take it out of our account.. with fail. they have tried for garnish us at two of my husband's past jobs.. with fail. now it's been almost 2 years since we heard anything and we are back on our feet now. has it went away or do I need to worry and get something done.

i went to court the first time and agreed to 100.00 a month to pay the collection agency had some problems meeting the obligation and now they garnished my wages i live in md. my question is do they still have to honor the agreement that was set at 100.00 or they can still take the .25 percent or can i take it back to court to have it reduced again..
