Wage garnishment - What is it and how can you stop it?

If you're unable to pay your debts on time, your creditors or collection agency may file a lawsuit and win a judgment against you. Then, if wage garnishment is legal in your state, creditor or collection agency (CA) may have the judgment enforced through a wage garnishment. A wage garnishment is where the creditor or CA contacts your employer and requires him to withhold up to 25% of your wages to satisfy the judgment, depending on your state's law.

How can you stop wage garnishment?

Once a wage garnishment order has been granted, it is difficult to reverse it, but not impossible. If you can't manage to pay your basic living expenses while your wages are garnished, then you should collect a "Claim of Exemption" form from your local courthouse and file it with the court that issued the garnishment order. You should also request a court hearing and object to the garnishment to explain your situation in detail. On the day of the hearing, you'll need to show documents regarding your income and expenses so you can convince the judge that the garnishment will adversely affect your financial situation.

If you don't contest or fail to contest the garnishment, you can either pay off the judgment amount in full or negotiate a reduced payment with the court. If your state's garnishment law imposes a lower garnishment amount, then the court will follow the state law when imposing a garnishment order.

While your wages are garnished to satisfy the judgment, a lien is placed on your assets and property and it'll remain until you pay off the judgment amount. If you sell your property, the sale proceeds will be applied first toward the judgment and then toward any other debt.

In some states like Michigan, a garnishment order expires after 3 months. Therefore, a creditor or collection agency needs to obtain a new order for garnishment 3 months after the first order has been issued. This gives you some more time to work out a payment plan with your creditors/CA or challenge the amount being garnished.

What's the best way to avoid garnishment?

If you think your creditor or collection agency is taking steps to have your wages garnished, the best way to avoid it is offer a payment plan you can afford.

The best way to avoid a wage garnishment that you can't afford, after you've been served, is to answer the complaint within your state's time limit and appear in court on the appointed day. This way you will be able to present your case to the judge before the judgment is issued. You will also be able to present the judge with a statement of your finances that will help the judge determine how much the creditor or collection agency may garnish.

You can also try to negotiate with the creditor or collection agency before judgment is granted and get them to agree to an installment plan. Dealing with the creditor, collection agency, and the court before the judgment is granted is easier and more cost efficient than attempting to appeal one.

What if the IRS files wage garnishment?

If the IRS has a wage garnishment order issued against you, contact them within 30 days of receiving the Notice of Intent to Levy, and come to an arrangement with them to prevent your wages being garnished. You can try for any of the options stated below to stop wage garnishment being enforced on you:

  • Pay the debt in full: Here, you pay off the entire amount you owe including the interest and the penalties you've incurred. If you don't have enough funds, consider borrowing from your family or selling your assets to pay off your tax debt. If you don't find this option suitable, try settling your tax debt with the IRS.

  • Offer in Compromise to settle taxes: Under this agreement, the IRS agrees to accept a payment less than what you owe on your taxes.

  • Installment agreement: This is where you agree to pay off your tax debt in monthly installments over a 3 year period. If you owe $25,000 or less in taxes including your interest and penalties, you can apply for an installment agreement online. However, if your tax debt exceeds $25,000, you need to fill out a Collection Information Statement, Form 433F, and mail it to the address stated on your tax bill, along with the Request for Installment Agreement, Form 9465.

the company that is garnishing my wages never sent out any court day. Neither did the court house;never received it. Therefore, i let the garnishment continue in which it stop 6months where i paid $4000. now this same company is garnishing me again saying i have a remaining balance of $2100 (1500bal + 600 court/interest fees). total bs bc the judgement i received later after the court date was in total $4567. what can i do if the company that is garnishing me suing for the wrong amount?

Had a house in Mississippi,had 2 orginally mortgages on it. Mortgage company sent a letter in 2006 saying the dismissed the second mortgage making me owe 14,000 in taxes. Took me 2 years to get this cleared up since mortgage company never dismissed it, I still paid both mortgages. Mortgage conmpany finally sent me the corrected copy of W2 and it has been cleared up for over a year now. The state of Mississippi sent me a letter saying i owe 4000 to them from same year but if I was in foreclosure then disregard the letter. I filed Bk in Oct 2010. I have sent copies of letter to state showing that I dont owe debt. Now they have sent Garnishment to my work.What can I do.

I have a very unique situation. In 07 my then husband was a habitual traffic offender in the state of colorado. The police took the vehicle and I was ask to sign some papers surrendering the vehicle, which I did and sent back. later that year I received a collections notice for a fee of 2000, they explained that it was a fee from the county because I never surrendered the vehicle. Unfortunately I didn't have copy of the papers I signed, but I did explain to them that I had a signed bill of sale from my then husband. Now I received a letter from my employer that they are garnishing my wages, how can I stop this?

So a long story made short. I went through all of the steps to get my judgment vacated on grounds of improper service. The plaintiff, an attorney for a CA, filed for wage garnishment. The judge granted it. At this point, I must state the court house is over-whelmed with CA's filing for judgments. I found out about the garnishment when my check was $300 short, my children's Christmas was severely affected.
Anyway, the judge is holding a hearing regarding the wage garnishment. I am suppose to bring in any supporting information. I don't understand. Can wage garnishment be issued after a judgement has been vacated? What supporting information are they looking for from me?

Christiniadavis..........the paperwork you received should have the place or individual who was taking the wage garnishment on it...or..information on the court house in which the event supposely took place. I would call the number on it (should be from a court house if it is an official document) and find out what's going on. I think that would be your first step.

Toni..did you keep copies of all transactions? Do you have paperwork that the judgement is no longer 'active'? You may want to go back to the attorney (or whoever you were working with) and show them your wages were taken. Ask for a copy of the paperwork that 'deletes' the judgement, etc. Then have that person file to refund the wages that were improperly taken from you. I don't know alot about wage garnishments, but, if you do have documentation that shows there shouldn't have been an 'attachment' then wages should have never been taken.

Here is some information that may be helpful to you. I researched some things on the web about Louisiana Wage Garnishment. As follows: The credit card company would go to your local court house and file a suit aqainst you. The sheriff in that county will 'serve' you papers. You have so much time to respond. However,..a credit card company can only take your wages if you make MORE than "30X the minimum wage" of the state of Louisiana. If you make minimum wage or less than that, your wages cannot be garnished. They CAN take the remaining debt from your tax refund. ALSO...certain types of income they CANNOT garnish(IE- IRA, Child Support, Assistance like 'Medical or Food stamps, etc.). A judge will then determine how much the CC companies can garish you. Hope this helps. :)

I only make 6$ an hour and credit card Co wants to garnish not only do I make 6$ an hour I only work 16 hours a week :( I have 2 children and live at my dads and i am on welfare (foodstamps only) can they still take. 25% I don't see how I am gonna make it and recieve no child support for either father. MYCHAEL....can you please tell me what state you reside in? ALOT of CC companies will send out 'threat' letters to people. Some information from you will be helpful: what state you live in; what you hourly rate is, etc. ..just so I can look up a few things on the web for you. Thanks.
MATTIAS....just curious how something like that could change. If the judge told you if you continue to make monthly payments, then the garnishment wouldn't happen. Do you have documentation of what the judge's 'order' was? Are you keeping up with you monthly payments?..do you have proof you are?

the remaining amount is $4000 and have my wage garnishment stopped because as of now (feb 2012) I have a credit score of 616 and I want to purchase my first home. about ten years ago i bought a car for 6,000. i got laid off but i paid on the car for 2 years. the car ended up getting taking away from the finance company due to lack of payment. 1 year went by and i started to get my checks garnished from work. so far i payed almost 12,000 and i changed jobs since. now i got another letter saying i owe another 4,000 in interest. can they do that. there taking so much money from me and it wont end. how could i stop it? so far about 15,000 total has been taking from me. does this sound right?

We are the creditor in a landlord/tenant case. The debtor has failed to make payments or payment arrangements for more than a year now. We filed a wage garnishment to the debtor's employer, allowing the debtor 30 days to file a response to the garnishment. On the final day of the response period (at least by the date on the letter) the debtor offered a settlement for less than the judgement amount, and it was not filed through the court. Do we need to respond rejecting the offer? Is it even valid since it did not go through the court? Will the garnishment go through since the offer was not filed properly? Any feedback is appreciated. Our case is filed in Maryland if there is the ability to access the specific laws.

After I lost my job, I tried to negotiate with them for lower payments. They blew me off.....I have since been put on ss disability so, the garnishment went to my husband. We never denied the debt, but they wouldn't work with us, I have records of letters, etc. that I sent to them ...now they are going to garnish his wages.....Is there anything we can do? I had a garnishment placed against me for credit cards. I have 3 bank accounts and all 3 were garnished but, the problem is that one account is actually my mother account but my name is one it. They garnished the income in her account but the only income that is going into this account is her Social Security income. I know it's illegal to garnish SSI. I have contacted the collection agency and notified them that the account has SSI benefits only. I have faxed them all the information needed to proved SSI benefit. What legal recourse do I have for them to return the money?

Hi Carol,

I have got a letter for writ of garnishment from the Dept. of Labor., I did file an appeal way back last year, heard nothing to date, But, yesterday got a letter for writ of garnishment, and i have 10 days to file or call the person from Dept. I have no means to try and pay the overpayment of unemployment, I do work and raise two grandkids and one daughter myself, i have so many medical bills, my house is bad i have to pull the washer to the kitchen sink to wash clothes, my house has no heat, all my money goes to feeding the kids, trying to fix the house, i have no car, no bank account, my credit is bad. I am struggling,, I have diabetes, still it is very hard, I did try and speak with the last lady that was in the dept. about the payment from another appeals dept. but she was arguing with me, that i knew all about what i did,.. very rude...
