I am a New Yorker that had a card that was "charged off" with a $1600 balance in 2005. I recently received paperwork from my local county sheriff's office saying That a judgement was entered against me for $2500(with their fees attached) in 2007. I called and said i did not EVER receive anything about this, as they had sent mail regarding the issue to an address where I no longer live.(not since 2004) I read the paperwork in its entirety, and it stated that they would send to an employer where I used to work a notice saying they should garnish my wages until the amount due has been paid in full. I have not been working there for quite some time. When I did, since I am a Realtor, I was a 1099 independent contractor anyway. I have since then started working with a new firm. I am not in title on any real property, my car is jointly owned with my husband(still has a note) and beyond that I am tapped out because of a car accident I had where I was repeatedly rear ended by a tractor trailer resulting in 3 surgerys(maybe a 4th on the horizon). My husband and I do have a joint bank account, and my question is if I don't pay, will I reach the 7 year statute in 2012 and no longer be responsible for this debt? can my joint bank account with my husband be garnished, or somehow will he be affected? I think the best services with credit cards can judged through the interest rate and the the credit period allowed to the customers.
Low interest rate and longer credit period is preferred by the customers.
Credit Card Judgement
The SOL in New York is 6 years. As the SOL period has not expired, you are legally bound to payoff the debt. Once the judgment order is issued by the court, your creditor will get the right to garnish your joint bank account with your husband.
