I just received notice that I am being sued over a deliquent credit card that I have not paid on in almost 4 yrs when my husband got cancer. He is totally disabled and I have been caring for him ever since. All of my credit cards have went unpaid. My question is: the only income coming into our joint checking acccount is his disability SS and a disabled veteran benefit, so if the company obtains a judgement against me can they attach money in our joint checking account? How can I keep that from happening? I have not contributed any money to our checking account and none of the credit cards were in his name.

What is the amount you can pay on any bill. If you dont have a job
without getting a judgement against are garnishment is 5.00 a month ok to keep the creditors off your back if its a doctor bill or a bill of that nature.

I have a lawyers office calling me now sent me a letter to receive a debt from a dentist office, it is a very old bill and was off my credit but in the recent months the lawyer is trying to contact me by mail and phone. I am self employed and a single parent that receives no child support. I make just enough money to pay my every month bill. I am barely making it. In the letter the lawyer is stating that He was informed by my employer, which is not true I am self employed and that if this matter isn't resolved in 10 days then he will have no other choice but to issue an income execution to the sherriff or marshall. Can u give me some advise and help me on this matter . thank you.

I have a lot of medical bills and see by the replies that collection agencies cannot garnish my bank account. I have tried to pay a little each month to pay them off, but some creditors will not accept anything less that $50/mo. I am on SSDI. My husband has his own acct at a different bank. Can he be made responsible for my medical bills? I thought about using a prepaid credit card, but my bank is free with a debit card already.

Phew.......I sure am glad about credit card debt can't be recovered thru garnishment of SSDI. I got a divorce almost a year ago. Ex is supposed to buy me out concerning property. But actually he's being a jerk and refuses to show the property to prospect buyers thinking he can stay and live in it without selling it. So...let them take my share of ownership by selling it and put his rear out on the street. He came out smelling like roses without having to pay for nothing including my medical debts that accumulated during marriage. Had a state lawyer that was useless, but I guess I will win this one anyway. Guess it does hold true that "You Reap What You Sow"! He'll think twice before he abuses any one else ever again!

I am currently separted from my husband who lives in Tn. I live in Nv. He let a minor drive a car that was in both our names. The minor hit another car and now the ins company is coming after me for $1326. I jst learned my husband is receiving a retiremt/pension check from his county job from which he was fired from 2yrs ago. Can't the ins company garnish his retirement check? I just found out he is receiving this monthly check. Shouldn't I let the ins company know he has this income?

federal law title 15, chap.41 subpara 11.states ss and federal retirement pensions can not be garnished for any debts other than those owed to the federal gov.(taxes, child support, student loans, and alimony. The trick is only have those funds in your checking account. If other funds are in the account there is no way of assuring that only protected funds are there and they can garnish them. My acount has had only ss, fed civil service and military ret.If they garnish your account and all you can show nothing but the exempt monies in your account They are libel for $1000 dollars and court costs.this is one senior citizen that will fight back . If you have this problem contact fair debt collection.com ph 1-888-332-7252. Hope this helps

My husband got laid off over a year ago and I receive fed disability and that's our only source of income. Since we cannot make ends meet we plan to move to overseas where we can afford to live off of my disability alone. We have a little money saved up. What can bank do if we stop paying the credit card and move out of the country?

I want to clarify further. we will send our money to an overseas bank in a country where we will live and the disability income will get direct deposited to an overseas bank as well.

Also what can a bank to if they cannot serve us in their law suit against us since we are not in the country?

I was denied SSDI and medicaid. My husband is on SSDI and medicaid. We are on food stamps. I am an online student and have medical bills debt, student loans debt and credit card debt. If I stop paying my medical bills will they go after me? I sell on online auction sites to do a little sedentary work I can with my limited health condition. Is this a bad thing? I have a merchant account with paypal and a prepaid credit card. Will I and my husband get in trouble? I found out we can get a savings account through the pre paid card too? Thanks for your insight.

My girl friend is 68 years old and just received a notice from a credit card company to file within 30 days to the clerks office, plaintiff and attorneys office. She has been sick for almost two years in and out of hospitals. Should she not show up for court hearing due to only income she has is Fedx pension and SS. I realize they win the law suite but they cannot garnish her retirement checks. Owns no properties and an old car about 13 years.

My pay is currently being garnished by a credit card company. I also received notice of another garnishment which will kick in, I suppose when the current one ends. I plan to retire from the federal government in the next year, can my federal retirement pay (I live in the State of Maryland) be garnished by credit card companies? Also, for statute of limitation purposes, how do I find out about open accounts - I haven't used a credit card in the last 8 years, but the garnishment I'm presently under is considered open?
