I am being sued for $2,800 but I am without an income. I was on welfare, but am no longer recioeving it. I have never been sued. What will happen?

Lucy, Alot can happen. They can take it to court and get a judgement. When you do start working they can then attach your wages and also any bank account you may have.
Do you expect to have any work in the near future? I would first send them a debt validation letter and be sure they own the debt. If they can prove they do then try to work something out.

Also how old is your debt and when was the last payment you made on it? You can find this information out on your credit report by looking at the origianl creditors listing. I am trying to see if you may be protected by the Statute of Limitations.

great advice fireyone, she may be well past or close to the statute of limitations. Collectors get pretty agressive when this time nears.

Lucy, be aware that if it is close to the statute of limitations for your state and if you make a payment, it will start the clock ticking again, so make sure that you look into this before you make any arrangements. Even if you pay a dime, it will start the clock over.

Hi Sara

I can understand your situation but is there anyway you can get in to a payment settlement? If yes, then maybe you could try and talk to your creditor and explain to them the situation. They may make you an offer that you can afford. Or better still make them an offer that you can afford because as it is this debt is in collections and will be pursued. They may sue you if they want. If the creditors get in touch with you try and negotiate the payments with them.

i am being sued for 1100 and he expects me to settle for 3000 yeah right, i'd rather go to court

I had the same thing that "ticktock" experienced happen to me. Equable Ascent is supposedly suing me (according to some other law firm who contacted me by mail about taking my case). I have never been contacted by Equable Ascent, but I received 2 different letters from Legal Recovery Law Offices (LRL). After LRL's first letter I sent them a request for debt validation about a week after I received it. They replied with a letter simply stating that they verified my debt (without indicating who they verified it with). They sent me no tangible proof of my obligation to pay this debt. In their first letter they never even revealed the name of the original creditor. In their second letter they stated that it was Chase Bank. They sent me no proof of anything. All they sent were the two 1-page letters. They don't have a leg to stand on since they didn't actually validate my debt, right? By the way, I have not actually been served a summons and I cannot find the case listed in the online database on my local Superior Court website. When I enter the case number, it simply shows "no records."

I just wanted to mention a couple more things about my situation which I had discussed in my previous post. Equable Ascent shows up on my TransUnion credit report right below Chase (the original creditor). They are both on there showing the same debt, but Equable Ascent shows a different account number. Aren't they supposed to show the account number of the original creditor, and not their own account number? Or, shouldn't they at least be required to list the original account number in the entry on the credit report? Besides those points, doesn't it violate the FDCPA by even having this alleged debt show up on any credit reports without it even being properly validated? I did send Legal Recovery Law Offices a letter stating that they had not properly given me tangible proof that I owe this debt. They never responded after that letter. Therefore, their "client", Equable Ascent, should not have had this alleged debt listed on my credit report(s). Also, there is no note on my credit record showing that I had disputed the alleged debt. I thought that was required when a debt has been disputed.

I receive a letter from LRL about a credit card debt originally by chase and bought by midland managment. i tried to negotiate with LRL to to go on montly payment but they will only settle for the amount of debt 10500 which is not the amout i owe. they want two payment with 30% off or they will go to court. will they go to court if I dont take this.

You as consumer have so many laws that protect you against the collection agencies. All of these debt collectors are criminals who are trying to make quick buck off people. It doesn't even matter if you owe the debt there are so many laws that would protect you from these criminals. Check the FDCPA. If a collection agency makes threats against you for non-payment that's illegal and they can be fined and you can be awarded $1,000. If they harass you that's a fine, if they call your family members more then once that's a fine, if they call you before 8am and after 9pm that's a fine. There are so many attorneys out there that can help you go after these people and they won't even charge you a dime. If there is a judgment filed against you either get Attorney Asap or file answer of denial but whatever you chose to do. DO NOT IGNORE A SUMMONS.

I was surprise to see how many search results came up for this guy. I just got a letter from my bank that he Subpoena my bank info. I have been contacted by this person before before all of this. Well not that I know. I used to live in California and moved to Chicago in March 2011. They seem like asses. Good to see people feeling the same way.
