This August, my granddaughter was informed she owed $1400 for a broken lease 10 years ago. She asked for a copy of the lease but was told by collection agency they didn't have that information. Long story short, they convinced her to pay $500 even though she doesn't know if she was on the lease. She made one payment of $50 in August.

do you have all your credit reports?
what state are you in?
what is the original creditor and the name of the CA?
what is the date of first delinquency? 30 days after last payment 10 years or Aug

this information will help me make suggestions specific to your case. The state will determine the statue of limitations for this debt. knowing the name of the OC original creditor, will help show if there is a specific govt regulating agency that can help so rt out the truth. Knowing the exact dates is very important too.

She does have her credit reports and this debt does not and never has appeared on them.
She lives in Florida now, but lived in North Carolina when debt occurred.
I will have to get back to you about the name of the original creditor. It was a rental lease in an apartment complex, if that helps. The collection agency is A&S Collection Associates, Inc in Williamstown, VT.

I'm not sure what the date of 1st delinquency would be. She had not been informed of this debt until recently. She lived at these apartments with her boyfriend. When they split up, she moved back to Georgia while he remained in the apartment. She doesn't even remember if she signed the lease.

Received this clarification from her yesterday (10/19/2010):
"When they first started calling me I told them that I have no problem taking care of this if it is something I owe, all I wanted was to see something in writing before giving them any money. That's when I gave them my home address, never got anything. They called back and said they sent it but I didn't get it so I gave them my personal AND work email, never got anything. In the midst of all that is when I gave them $50 just to shut them up but I again said I'm not paying anything else untill I have something in writing. That's when a different person started calling me, i told her to not call me at work again and they were getting nothing untill I see something in writing. Then Michelle started calling me. I have told all of them that I will take care of this if it's mine I just want to see proof and I still haven't gotten anything except that one email from Michelle saying that they would accept $500 to close it out."

She needs to send the DV letter. This is an request that asks for all this information. They must reply to be in compliance with federal law. In fact when she asked for something in writing, that is technically a DV. She needs to invoke that date when she writes the letter. "As I requested on X, send me DV"

sometimes making a payment can cause a problem but I would not let that stop you. In fact maybe she should contact the attorney general and ask for her money back.

in NC, partial payment does not renew SOL but I can't tell about FL.
