Hi,
I have been served by a collection agency on an account that is due to fall off of my credit reports within 3 months. I disputed this account back in the summer. Equifax deleted this account but Experian and TransUnion verified it.
I have filed an answer. The SOL is up for his debt. They state my Date of last payment was in 2001, March. Everywhere I read, sol for credit card debt says 5 yrs, however, it seems Ky statutes are not as clear as others.
I have denied, and do deny, that this account is mine.
Please help.
served by collection agency
Hi Angus,
If this is a credit card debt then this must be an open ended account. Thus, the Statute of Limitations (SOL) on credit card debt in Kentucky is 5 years. Thus, the SOL on this debt has expired. You can dispute this judgment on the basis of expired SOL.
Thanks,
Aaron
