Hi guys!

I am new here and I am going to receive a summons very soon. So, I am trying to get as many advice as possible. I need to know what to do about it, how to respond it and what kind of forms do I need.

Please let me know the legal action that will take place in NY state. I know my income is exempt as it is SSD. I also faxed them a copy of my benefit letter, with the money parts blacked out. Can they even sue me when they already know this?

Thanks for any information :)

Hi Roselyn,

Welcome to this community :)

Can they even sue me when they already know this?

Yes, the creditor/lender or collection agency can sue you for non-payment of dues, even if you are receiving Social Security Income. SSI is non-garnishable under the Federal Law but it does not essentially mean that the creditor cannot sue you.

They can sue you and put a lien against your property lir your house or your car.

Thanks,

Aaron
