me and my wife have been separated for about 5 years , but we are legally still married, i have a common law wife , i have been with her for about 4 years, we have two kids together, my wife that im legally still married too, took out a car loan without me even knowing, she didnt pay the loan, and now the loan is on my credit, as not paid off, can i take my name off that loan...........
your name cannot be on the loan unless you signed for it. A judgment may be different depending on the laws of your state.
So write the owners of the trade line and ask for documentation of the loan. I would specifically explain that you never signed any loan and if you name was signed it would be fraud. State that you need to see the signed origination papers. there is a good chance that your name is not on the loan and and the collectors are just trying to con you into paying. if this is a judgment and you live in a community property state, then you may have a problem.
you know you can get a separation agreement without a divorce.

im from texas, and we werent together at the time , she took out the car , i didnt go with her , she told me that she took out that car by herself without my credit, because i wasnt notified that she had took out the car in my name also, i dont understand why its coming out on m y credit report if i didnt sign no loan aggrement.
I will bet you magic points that she did not take out the loan in your name. the bank or the dealer ship would have asked for ID made you cosign in person. It is probably a scammy collection agency that thinks they can trick her husband into paying it off. TX debt laws are favorable to the consumer. Write to the address on your credit report by certified mail with return receipt. this will be a DV letter . Specifically ask for a copy of the signed loan document. Either you are not on it or your wife committed fraud and you will report it to the police.

You should immediately send a debt validation letter to the collection agency through certified mail, requesting a return receipt.
You will get sample debt validation letter with this community which you can use to write a validation letter of your own.
