I just rcv'd a notice that a judgement was filed against me and my(deceased 2008)ex-husband in December 0f 2003! I never lived at the address where they said I was served, in fact I was at work 100 miles away...I did not find out about this until 8-26-10...this debt was alos in court documents to be paid by my ex and i was not tobe held responisble...I was remarried in 2002, and have lived at the same address since 1998....how can they say I was served properly, and why now after 7 years...I would have attended the court case and appealed or at least gone back to court to sue him for the monies I paid...what do I do now!
judgment dismissal
Hi Seashell,
You were not properly served, and so you can file a motion to vacate this judgment. Moreover, there is a Statute of Limitations (SOL) on judgments. That is judgments expire after some time. This time limit varies according to the state where you live in. So, first check out the SOL on judgment in your state.
However, judgments can be renewed before it's expiry. If this judgment has been renewed just go forward and vacate it. If you have any documents to prove that you have been living at a different address from 1998 then make copies of that and provide in the court as proof of your claim.
Hope this helps.
Regards,
Aaron
