I leased a car and went over on the miles back in 2008. I owed 2800 for the miles over. Ford motor credit hired an attorney to come after me soon after charge-off. I received some papers in the mail that they were suing me. I had no money at the time and paid no attention to it. There was never a judgement or anything so I just went on with life. Recently i have been trying to clean up my report and get things paid off that i owe because I came into a little bit of money. I sent a letter to ford since they were the only listing on my report for this and offerend 1800 to settle it. they then forwarded it to the attourny and they contact me and say they are now in the process of filing the suit against me and said the total is now up to $4000 due to the original 2800 and adding 1200 in lawyer fees. My question is can they add the fees to the balance like that and offer a settlement? They offered me a settlement of 2800 which is the original balance. If they win a judgement in court does the judge add lawyer and court costs to the judgement?

Yes, they can do this. The judge adds lawyer and court costs along with the outstanding debt amount if requested by the creditor.

do you have all your credit reports?
what state are you in?
what is the name of the CA?
what is the date of first delinquency? 30 days after last payment

A lease is a written contract and so this is not like most debt. How are you sure there was no judgment?
