Still have not been served for a lawsuit…I think they are

I recently found out that there has been a lawsuit filed against me. I found out by lawyers wanting me to hire them to help me. Then on Monday I found a door hanger, that wasn’t on my door but on the floor!, and it said that I missed my delivery. I knew it was them so I called and left 2 different times they could serve me the papers. One of the times was for an entire day, and nope nothing yet. I called back again and left two more times and still nothing. Having read some other entries I am becoming worried as the company suing me LVNV Funding LLC and from what I read they do not do things the right way. I am becoming concerned that they will try to deliver the papers somewhere else so that I do not have enough time to file an answer to the complaint. How do I make sure that they serve me?! I do not want them to try and send the papers to an old address or worse my place of employment. Also I have a couple different copies of my credit report and they have changed the amount they claim I owe many times, now since the lawsuit has been filed, they changed it the amount the original creditor claims I owe can they do this?

Hi woodliha,

Welcome to this community :)

I think you should first try to know if there is really any lawsuit against you. You can find this out from the court. Visit the county court and the court in your state to find out if there's a case in your name.

You need not worry about not getting properly served. If there's a case and you do not get served properly, you can file a motion to vacate the judgment.

Also I have a couple different copies of my credit report and they have changed the amount they claim I owe many times, now since the lawsuit has been filed, they changed it the amount the original creditor claims I owe can they do this?

Check the contract with the original creditor. When an account gets sold off to a collection agency the terms of the contract remain the same, and thus interests and fees can get added (as mentioned in the contract).

Thanks,

Aaron
