I received my paycheck today..with plans on getting my electric turned back on (successful). And I have promised to pay my landlord my remaining rent for this month. I noticed my check was $377.00 less for this pay period. Upon calling employer-they had given me the info about a garnishment from a 2005 hospital bill? In which case, when I called the # to find out what this was about, it was an attorney who stated I had been served in 2008...NO-the address that they had was for a place in Rockledge, FL. I have never lived there. I guess it went back to court on July 6, 2010 and garnish almost $800.00 a month. And this garnishment has caused me & children to be evicted on the 14th of this month. How do I appeal this...I never received any court dates...how can I respond to the court. Please help...I am a single mom...I praise GOD that I have a job, but now I am not going to even have a home in which case, no job...someone, anyone, do you have any advice......

garnishment without proper notice
Hi sunnydawn,
Welcome to this community :)
You can fix this problem by filing a motion to vacate the judgment. If you do not get properly served you can file the motion to vacate the judgment. Go to the court from where you were served, and request the court clerk to give you a form to file the motion.
Also consult a lawyer for better advice. Nowadays many lawyers give free consultations. So, you need to find one in your area.
Moreover this is an unauthorized withdrawal. Thus, you should file complaint with the Federal Trade Commission too.
Thanks,
Aaron
