Generally speaking, the Statute of Limitations restarts as soon as the person comes back, and starts using his credit. However, whether or not he can be arrested depends on the state laws I believe.

My wife and I moved from the UK to Canada a couple of years ago. She had a long term loan she had been paying (before we were married) and in her name only.
after a year of moving she had been paying it and got it from £11k to £8k. as her money was running out (wasnt working in Canada) she called the bank and informed them of her position, as they always advise. They said there was nothing they could do and to call back when she was in arears!!
a year later they have sent letters and finally sent it to a debt agency in the uk, who have sent about 3 letters, although the letters were coming from Hungary and Germany??
We recently received a letter stating that the agency had, or will sell the loan onto a canadian company who they call at the door.
They did say though that she had the option to pay now and get 40% off the amount. Their last offer.
I know its long winded but the question is... Can they legally sell the debt to a Canadian company to collect it.

I am under impression the UK loan cannot be collected here as she had paid for a certain time and it's under the UK comsumer laws?

Generally speaking a person cannot be arrested for his debts. However, once the person comes back, the Statute of Limitations restart. You will have to check your country and state laws on Statute of Limitations.
Hi, I know of 2 people leaving South Africa over a week from now. An old age home looked after there father for a few months and they need to pay them before they leave but they do not want to do that. How can I stop them as they owe a few institutions money in South Africa, can Immigration stop them to go to Ireland? the wife has no work and the husband is working on his wife's previous work permit in Irlend. Its now been 11 years Ive moved to Australia and never been chased again, I wouldnt be game enough to return to the uk in case I was stopped at the airport. I have been told be a bankrupt/insolvency company that to successfully get away with it the new country you are going to - never apply for credit, use a prepay phone and internet and only have a savings account at the bank and do not have any credit cards, Dont sihn on the electroal roll etc, and if by some chance they catch up with you just say your unemployed and have no money, Cause your in a different country they cannot prove otherwise and they will more than likely write it off as there is no point flogging a dead horse, Good luck everyone hope you get away with it, banks are gready

Over the last 12 years through the ease of getting credit I've got myself into a right mess.....the debt I owe is split over a bank loan and about 6 credit cards so the max I owe anyone is just over £10,000 but totalling around £47,000. Feel completely out of my depth now I have always made at least min payments but am just getting no where and most of my wages go towards this! Anyway to cut a long story short I work within the nhs (so have a professional registration) and have got a job and visa in oz. Leave in a few months....issue is should I try to move money back here to keep paying and struggle ridiculously for next 6/7yrs or start afresh?! Can they catch up with me? Also want to come back to visit family 1/2 times per yr would my passport being swiped at the airport make people look for me?!!!

Your credit rating in the UK has no effect on ur oz rating. You just start from scratch.
They only thing I am thinking about is this being held at the airport business. Can they do that? I dont think you can as i was under the understanding that leaving debt behind is NOT illegal. You cannot be arrested for it.
Worst comes to the worst, if u want to go back on holiday, then get a flight to Ireland, train up to Belfast and fly to the UK domesticly.
My friend pays a monthly payment for a loan to the bank but the bank has sold the debt on to another. She is still paying the monthly payment but has no paperwork for 2 or 3 years and does not know if her payment is being transfered to the other country towards her debt

Well amjad, this thread is assuming America, where you cannot go to jail for having debts. However, in the UAE you can go to jail for having debts (for a while anyway, they still expect you to pay it back), I would only imagine the horrible things they might do to your family if they found out you left the country.

I left UK in 1995 with GBP 5000.00 debt. It was transferred to a US debt collection and total cost with fees were over GBP 15000.00. Try to make an arrange to stop interest charges and make regular payments of the principle. Most banks are happy with that as they normally sell off bad debts for a lost.

My NZ Debt referred from collection agency back to bank
I am currently a little stressed as years ago (approx 6) my personal loan with Westpac Bank was transferred to Aorangi Debt Collection, over the years I have been paying the debt slowly, however recently (due to my own fault, travelling) I missed a couple of payments and did not contact them to notify, I realise this is very irresponsible on my part but it is not that I don't want to pay, I haven't been working for the last 5 months due to some personal reasons, however yes I should have contacted them. Anyhow I am still out of New Zealand (only a perminant NZ resident, not citizen) i am staying in europe but of course dont want any issues returning to NZ. I contacted Aorangi to say that I have just made a payment a few days ago & to get an update on te balance of my debt (should be approx 2500NZD left now), however they advised me that the account has been closed and sent back to Westpac Bank and so to contact them. I have emailed (no response as yet) & tried calling but haven't made it through to anyone yet, I got the response from Aorangi last night and it is now the weekend and in my mind i am thinking of all kinds of worst case scenarios! I am currently not working and have no money to pay, my fiancé is supporting me and could help pay in small instalments only. Please advise if possible the most likely outcome for a situation like this? Any advice would be greatly appreciated.
