I got behind on my car payments w/National City(now PNC Bank) late last year. They never repo'd my car. I now have the funds to pay my loan off, but when I contacted them, they referred me to CCS Collection & gave me their # (I've never rec'd anything from them). When I contacted them, they said they had been given permission fr PNC to negotiate my balance in half. I agreed, and like an idiot, I gave him my bank acct info, after he promised he would send me an agreement by mail. Obviously, nothing ever arrived. I put a stop payment on the electronic check. When I called him, he said he could fax me the agreement, but that it would take 30 days after they withdraw the funds from my bank for the check to clear ~ huh?? No big shock that the letter was dated 4/1, with an agreement null & void date of 3/31! I don't trust this company, but I want to pay my loan off & get my title! How can I find out for sure who now holds my title, and how I can get it? Thanks

Then I would keep trying to get a real agreement. You have the expired agreement. that is a situation that can be fixed.
btw, NEVER NEVER NEVER pay over the phone. I would actually change your checking account number.
Send a letter to CCS by CMRRR with copy of the expired agreement. Tell them that you are concerned about the strange actions of their rep, and exploring legal options. YOu will consider this offer if they reply with a new letter that gives you at least 20 days. Then get a money order. there is nothing wrong with recieving the agreement by fax but send it back by CMRRR with the mail article and money order number in the text of your letter.
Thank you so much for your good advice! Another of my concerns now is if they even own my title?? They told me that Nat City is their client, and that Nat City holds my title & they would release it 30 days AFTER my payment cleared (which they said would take another 30 days). That would mean that they'd have my money for 60 days before any hopes of ever seeing my title! BTW, Nat City confessed that they do NOT have my title, and that they no longer have any interest in my loan... I'm concerned that they may have originally bought my loan from Nat City, but when they couldn't find me, they sold it to someone else. Remember, I contacted THEM first, so my suspicion is that they no longer have this account & they're trying to get money that doesn't belong to them. Very frustrating... Thanks for listening :)
I am not an expert on this but I think you get your title from the state once the lien is released. I don't if you submit paperwork or it happens automatic but I think that the state issues a new title.

(Just putting in my '2 cents') CCS had sent me a letter, sometime ago, on a debt, they SAID they "now owned." I had called the OC and the OC said they never "sold the debt and I can still deal with them." So..I called CCS and told them this. They gave me a bunch of crap, saying "if I don't give THEM the money they can show up at my door,..blah,blah.. I hated dealing with them.
sdchargers, that is all well and good but OC don't settle for less or PFD. it seems that the OC referred the OP to CCS so the OC won't deal with him.

To know who now actually holds your account, you can pull a copy of your credit report. From there you will come to know the name of the collection agency. You can then send a "debt validation letter" to the collection agency. For sample validation letter, you can refer http://www.creditmagic.org/repair/sampleletter-debtvalidation.html .
After the validation, you can talk to them about the payments. This time don't make on-line payments. Keep copies of the payments. Send the payments and all the letters through certified mail, requesting a return receipt. In this way you will have the proof that you have sent the letters and have made the payments.

I am not sure that listing on your credit report is proof of ownership. THat is what the DV is for.
