I had a garnishment started last year. I couldn't get off work to attend the court date; but then again, I do owe this company. However, I have let them do this to me since October and thought I was making some headway -- watching it on casenet. I checked tonight and they have added another $1000 onto the original amount! I have been overdrawn every pay period since this started and am going down fast. Is there anything I can do?
interest added on garnishment
Hi Evilj,
As far as I understand, a creditor or collection agency cannot add interest on a garnishment without another court order. Thus, you can go and check the details of the case filed. Request the court clerk to provide you a copy of the case. You can then check if the judge specifically gave any orders regarding interests.
However, rather than allowing them to garnish your wage and account, you can pay off the debt. If it's not possible for you to pay the whole amount, you can request the creditor or collection agency to agree to a settlement. For more details of debt settlement you can refer to http://www.creditmagic.org/blog/2009/04/06/debt-settlement-the-way-it-w… .
Hope this helps.

garnishment
Thanks Aaron. I checked the case on the court's website. As of 02/18/10, I was down from $4708 to $2033 so I thought it was slowly being taken care of. But the updated amount as of 03/08/10, is back up to $3299! So I'm not getting anywhere. I also checked on any notes from the court -- it says "AFFIDAVIT FILED. JUDGMENT SHALL BEAR INTEREST AT A RATE OF 24.00% PER ANNUM". This has taught me so much about why it's important to ALWAYS pay bills on time!
