my husband recived a summons where i was listed as jane doe so we answered the summons now they sent me (and only me) a letter asking me to ask them to validate (seems odd to me ?) and they also want me to call them but for what?

so now we got papers from the court and they say disclosure statement but the answeres are blank now are we supposed to fill these in and file them?

what exactly is a disclosure statement and whats it for ?
again are we suppose to fill em out and file them?
what happens next/now?

and should i call them even though i have no idea what i contact them for since i know for a fact i dont owe or just wait to see if we get a court date?

Hi rdelmarra,

Disclosure statement is a copy where the debtor is required to provide all the details of his assets and liabilities. A disclosure statement is sent to the debtor by the judgment court after the judgment is issued. The debtor is required to submit the filled disclosure form to either the creditor or the court clerk.

The disclosure statement needs to have the following details of the debtor:

1. Name and address.
2. Employer and the employer's address.
3. Real property owned by the debtor.
4. Cash on hand.
5. Financial institutions in which the debtor has funds.

You can call the company and inquire into the matter. Ask why they want you to call them.

Hope this helps.

Aaron

Hi rdelmarra,

Can you give the details of the civil case notice? As for the "motion to set and certificate of readiness", it is filed when you want to go forward with the trial. It is the certificate to show your readiness for the trial.

If you had not been served with any notice of the judgment, you can claim this in court. The creditor or collection agency is required to provide you with a notice of the judgment filed. However, you should first make sure about the notice being served to you. Whether or not you received the notice.

Real property can be your house, land, your car, etc and the privileges included with the real property.

Hope this helps.

Aaron
