Under the federal law, social security income cannot be garnished. One thing that your mother can do is open a new account in another bank. She should also inform the bank that, her money comes from social security. This may help.

Therefore, it is better to get a written contract of the settlement. You don't need an attorney to deal with the case. However, you can go for a free counseling with an attorney, for dealing with this case. You should appear in court, and provide them with a copy of your monthly income and expenditure. This will determine the judgment amount. Your social security cannot be garnished. However, your wage is garnishable. At least 25% of it can be garnished. It also depends on the type and amount of debt.
However, you can try and settle the debt with the creditor itself. Debt settlement lowers the outstanding debt amount by 40-60%.

Somebody's wage or account, who is supposed to pay for the child support, can be garnished. However, if money accumulated into a checking account as child support can be garnished or not depends on the state laws. As such, checking accounts are garnishable.
However, if your state allows no garnishment on child support account, and you can prove this to the creditor, they may not be able to garnish money from your account. The account should have money only from child support.

I have few credit cards some of them limit is 300$ some of them 2000$ . my total debt on all of them is not more than 6000$. I was paying my bills always on time-never late for-6years. lately my financial situation got very bad and im not able to pay anymore. our bank took all my social security and my ten year old grandsons ssi,who is disabled and under my custody. i had a lot of creditors so I went to a consolidator and signed up with them. they were working on negotiating a payment for me and when they used electronic transfer of the account, it was closed. I notifed the bank and opened a new account there. They knew exactly how I was handling this situation. they (one employee) opened my closed account and used my monies to pay these creditors. leaving me $10.86 overdrawn and with no money for the entire month for food, medicine, or anything. This also voided the contract that the other company had with some of the creditors getting paid in full and other not at all. We contacted everone including the CEO of this bank and they said they couldn't do anything I filed a complaint with the FDIC and they forwarded it to the OTC which is where it is now.
PLEASE TELL ME THIS WAS WRONG AND AGAINST THE LAW TO DO?

If you don't have much money to afford a lawyer, you can consult American Bar Association. They will help you find a low cost attorney.

If the debt was included in the bankruptcy, you may not have to pay the dues anymore. Any debts included in the bankruptcy, remains noncollectable, even after the discharge of the bankruptcy. If the creditor is still calling you for the payments, you can inform them that this debt was included in the bankruptcy. Thus, there is no fear of getting sued for this.
However, if this debt was not included in the bankruptcy, you need to pay that off. Otherwise, you may get sued or your car may get repossessed.

As for the issuance of the credit cards, the bank is concerned with their own business. It is their job to issue cards. Can They Ganish My Alimony I Get?
Hi. I just turned 62, am on early retirement in Wisconsin. I get $475 a month alimony from my ex, part of his pension from a divorce court-ordered QDRO of $520.17 a month. My SS will be from taking some of my ex';s work credits, because I never worked but 2 years in my life. I am to start getting $721 the second week in April 2010. I have Credit Card debts from using them for living, because I was only getting that $995 a month. I have a car that I pay $305 a month on, and I still will pay that. I rent for $710 (split with roommate), and I will comtinue to pay that and my phone & electricity. I own nothing of value, just my clothes and a few older things (electric). My computer is on one of the Credit cards, and I would continue to pay that. I just have 3 cards that I cannot afford to pay any longer on. I don't want to go Bankrupt again. I did in 2000, and I only have this debt because of having to live. Can they garnish my court-ordered pension from my ex? Or 'any' part of my SS? Or my alimony? There are only 3 cards, and they total $9,500 total (roughly). I am only paying minimum payments now, and let's face it. I probably won't live for 20-some years to pay them off. I am in bad health, cannot see a doctor because I have no health insurance. I can't even afford food. I go to Food Pantries. If you could help me on this, I would appreciate it, because I have no extra money to hire a lawyer. My Illinois friend says that I can just stop paying them. I will get nasty calls but that they will stop after a while. She said I can do an do an "informal" BK by simply just stopping paying on the debts." I, personally never heard of this. Is this an Illinois thing? I owe now taxes to the government, no medical bills or hospital bills. I rob from Peter to pay Paul every month and hand-wash my clothes and put them on hangers on the shower rod.
