I recently found out that I have a judgement filed against me from 2005. It is from an apartment complex that I never even moved into! The amount is $2370. I was wondering if there was a way that I could settle this for less. Also, who I would contact to do so. The court or the apartment complex? I am applying for a mortgage and need to get this taken care of but dont have a lot of extra cash to put into this. Any suggestions would be greatly appreciated!
settle a judgment
Hi cmu,
You can contact the apartment complex and settle the judgment. You can tell them that you are willing to pay the dues, but can't pay the whole amount because of your financial problem. However, for that, you need to make a list of your income and expenditures. If your expenditure goes above your income, they may consider your case. However, not all companies like to negotiate the payment amount.
If the company does not agree to a lower payment, you can request them to agree to monthly payments. After the judgment gets paid, request the clerk of the court to give you 3 copies of Acknowledgment of Satisfaction of Judgment form. You need to fill up these forms, and mail them to the 3 credit bureaus. With this, the negative listing will get removed from your credit report.
oK wait can we start at the beginning? why would you owe money to an apartment complex that you never moved into? States have specific laws protecting renters and we need to explore that area to answer this well.
Also, why weren't you served?
