I fell for the kirby sales man almost ten years ago. Well I tried to back out with in the three days because it left black marks in the carpet. After the three days he answers and says well its been more then three days you have to pay for it. Well he said his wife never gave him the message so we are stuck with it. A court date was set that we never got papers on and that happened in 2000. Well yesterday the cop shows up at my work and they put a frezze on my accounts can he do this after all this time?
why would the police come to your office to freeze your accounts?
I work for a bank so the cop had to bring the summons garnishment and freeze my accounts
Garnishment
Hi kdstaab,
As far as i understand, though the judgment for freezing bank account dates back to 2000, the creditor can still continue to garnish your account, as legally you still owe the debt. The creditor can also continue to garnish a person's account till the garnishment order expires.
However it is always better to contact a lawyer for advise, in such a case.
Hope this helps.
Regards,
Aaron.
I would get copies of these court records.
Don't they have to send the person something showing that they are garnishing their bank account? I also always here people say they never knew they had a judgement. How is this possible? I always thought they had to send you a letter to make you aware of the court date. Some of these things are still confusing to me and I have been a member here for quite a while.
reply, judgment
Hi fireyone,
When a person is being sued, the creditor needs to sate that to the debtor. The creditor must also provide the debtor with all the court dates. However, if a person changes their address without informing creditors and companies, it may not be possible for the creditor to send letters to that person.
Thanks for the explanation. I always wonder if maybe a better system should be put into place. People move all the time. I believe (and know of someone) who the collector contacted them at their new residence and even sent letters there but when they sent out anything else that pertained to the lawsuit they sent it to another address..the previous one. I think this should be illegal and if proven they should face fines and have to relieve the debtor. So many debt collectors are so underhanded.
judgment notice
Hi fireyone,
What you say is really a matter to be taken into consideration. You have talked of change in credit rules in another thread. I believe that this issue needs to be considered too, while changing credit card rules. The debtor should be properly served with the notice of the court dates.
