Court summons and judgements

I recieved a summons for court for non payment of a loan. I am in the process of filing bankruptcy in a few weeks. My court date is in 3 days. If i do not show up, how long will it take for a judgement to take effect? and will the judgement be dismissed once i file the bankruptcy?

we will be filing in about 3 weeks. Just wondering how quickly judgements take effect or if i have a window of 30 days after recieving a judgement to do something.

Hello missyp,

I will advise you to show up in the court and let them know that you are filing for bankruptcy. And as for your question, that will the judgment get dismissed after you file the bankruptcy, I should say that it depends on the state where you live in. Check that for your own knowledge.

However filing bankruptcy can adversely affect your ability to obtain future credits.

Whether or not the judgment will get dismissed depends on some criteria. Firstly, it depends on the chapter you have filed for bankruptcy; chapter 7 or 13. The dismissal also depends on the state you are living in and the SOL of that state. The SOL is different for different states.
