I am not real sure which would be worse, charge off or bk7, either way it will stay on the negative side and affect your credit, it will be there for the seven year period, how old is the debt?
If it has been on there for a while then you may be better off just leaving it alone and letting it fall off, it will always be in the negative anyway.
Did you have a lawyer when you filed bankrupt? If so I would give that person a call first. Doc is correct it is a huge violation and they can get in trouble. I see Goodnatureds point about it being a negative regardless but I would think being listed as a bankruptcy protects you from being sued by collection agencies or anyone else for the money owed on the debt. I would get it listed as soon as you can.
Good point fireyone, if an attorney was involved you sure pay them enough, they should draft you a letter that states that you have filed the bk and that this debt should be reported appropriately on your credit report.
The attorney should SUE the creditor for a violation of the stay that is granted in the BK... It's generally a slam-dunk lawsuit... If you need an atty, call me... I'll be happy to help you find one...
I had the same problem with one refusing to report it as included in bankruptcy until I let them know I had the federal trades commission involved. Then they couldn't correct it quick enough. I wish I would have known I could have sued because I wouldn't have done that quick enough as well. I have just had some bad experiences with these companies lately.

I would sue them if they don't comply... That is a HUGE violation, and it is very actionable...

I would sue. They surely get away with enough money so why not get a little of theirs.
