Can a CA add a collection to your credit report when you're still awaiting validaton from them?

Hello Jimbo and welcome to credit magic. I am not sure but I have requested debt validation recently and the collection agency who was reporting is still listed on my report. For some reason they are listing under "debts in good standing" so I am not sure if this has anything to do with it. My educated guess is they would still be able to report unless the time period has passed for the validation or they could not validate. At that point you could then dispute the debt and get it removed.

Thanks fireyone, I did request the validation within the 30 day timeframe so I'm assuming that what they did violated fdcpa. They had made some other violations as well and I've already filed a complaint with the FTC. Any more wrong doing on their side and I'll do the same with my atty general and the BBB.

Hello Jimbo, I didn't even wait for them to cause e any problems . I just called the atty general right off. My collector was trying to collect on some account I was an authorized user on. They would give me no information to the debt or even who the original creditor was so I got angry and called. He had called them on the spot and took care of the problem. I also would go ahead and get that call into the BBB.

In Texas we do have this 30 days time frame, but is it applicable for other states also?

They had made some other violations as well and I've already filed a complaint with the FTC.

Is it possible for you to share any of these violations with us? I'm sure it would help many of us to know about the kind of harassment we might face under such circumstances.

Hi Plasticmind,

Yes, the 30 day timeframe for YOU to respond to their initial contact is in the FDCPA, so it applies to every state.

As for the violations. They ignored my validation request and sent me notices saying I was ignoring their efforts to resolve the debt. They said that unless I agreed to and followed through with a repayment plan I'd face a lawsuit. Then they reported the account to Experian. And if I've done my homework on them correctly, they aren't even licensed to collect in my state!
