lvnv did not show up in court in nc and the judge dismissed without prejudice so they may sue my again, but do they have 10 days to sneak it back in on the docket, and if so how am i notified - i have moved out of the state due to fiance''s job.
Hi Myaveska,
The LVNV did not show up because they did not have the proofs probably to fight the case. Anyways if you are moving out station, then you must let he court know about this, so that if any proceedings take place they can intimate you.
Hello, Yes the court would let you know as long as you update them with your new address. I will agree with Justin though, more than likely they did not have enough or any proof to get a win in court. Now even though this is more than likely the case please be sure you get the address updated. You do not want something to happen in just because you did not do something as simple as refile your address.
why 10 days?
when does the sol expire?
I thought that once they filed with the court it made the statute of limitations stop in their place. A family member had a company file over a year ago and it has never yet seen a moderator or court room. My family member told me that the SOL was stopped and it could hang around forever or until they decided to press forward with the issue. I myself can not see the fairness in this. I would have imagined after they file suit with the courts they would have so long to follow up.
