Past Bad Credit

A friend of mine (seriously) recently tried to get a bank loan and found out he had $30,000 in past hospital bills dating back to 1995!!!! He was on Tennessee's Health Care System (TENNCARE) and assumed all debts had been paid since he hadn't received any bills and never had any monies garnished from his check. His credit is in shambles! Please let me know how he can get this taken care of so he can go on with his life!

i think after so long it can be disputed. and there is something called SOL which means that after so long they cant go after him for the debt; which he would need to look into before beginning any payment.

of course there are other options too, like debt settlement and such or even bankruptcy if needed. rebuilding his credit will take time though. its not an overnight thing. that's why it is important to check your credit annually at the very least.

I really believe you need to dispute this with the credit agencies because I believe this should have fell off of his report at least four years. I don't know of any debt that would be listed longer than seven years except bankruptcy and that's only ten. Now if he has paid anything on it in the past now that would have started the SOL all over again. And that would explain why it could be still listed. But check the SOL in your state and see if it has past. And if so do not pay anything on the debt because it will start the SOL all over and then he will have to pay the debt.

Hello Guest and welcome. I would have to believe that after fourteen years the Statute of limitations has run out on this debt. I just pulled the states SOl and it is 6 years across the board for all debts. Unless your friend has made any payments on the debt with in the last 6 years ( I am assuming he did not since he had no knowledge of the debt) then I would get those dispute letters started as soon as possible. The time frame for reporting debt is 7 years so actually this debt should have fallen off years ago. This is another example of why people should use their three free credit checks a year!

wow fireyone, that's really scary. im not sure if you were one of the people telling me to look into my deceased grandpa's indentity being stolen. I've tried looking into it & havent found anything. so, the collector trying to claim something was really weird now. especially since he's been deceased for 21 years and with you saying the SOL is like 6-7 years. That IS weird. Now, I'm really confused about that debt collector calling. Totally lost actually. I dont know what else to do to look into this, especially when it wasnt even a "person" calling just a recording, but I hung up like my gramz told me too. so now i cant even call anyone about it. hmm. maybe i'll do some researching online...

(Hi, FIREYONE!!).....yep.....it SHOULD have 'fallen off' by now. I would send a letter to the CB's with the proof of the debts being on your CR's for more than the allowed time. The CB's should 'remove' the debts and update your CR's.
