I have a judgment against me for a credit card debt. I lost my last 2 jobs - lay offs - and was forced to take my Social Security earlier than I hoped to survive. I have no other income or own any property.
Two questions:
1. If I have a joint checking account with my wife can the creditor put a HOLD on the account?
2. I have no wages or employer. IF I won $10,000 on a lottery ticket or at slots can they take that money?
I'm in a bad situation at the moment and any HELP would be most appreciated.
Thank You.
John
Hi J Stevens,
Your joint a/c with your wife can well be garnished. About the winning a lottery ticket, if you do not put them in a savings a/c then you may be able to save them. I would suggest that when you go to court you will be given a chance to defend yourself. You may place your points then telling them how you don't have a job and why you are not able to pay.
Usually if they see your name on it. They will garnish it doesn't matter if it's a joint account or not. You may consider closing the joint account and getting your wife to open one by herself.
