A judgement was placed on my account. I have been negotiating with someone about this debt for the last week and now there is a judgement on my account. Will they still negotiate or once the judgement is placed, is it done? I live in NY
How old is the debt? Did you check the SOL in your state? If the SOL on the debt hasn't past and if they get a judgment they will continue to garnish until they get their money. And then the only way out is to pay it off. But if you have been trying to work out something with them and they still got a judgment against you they probably are not going to.
I think it is about 7-8 years old. What is the SOL? I am new to this site.
SOL is the statute of limitations, each state has their own laws on statute of limitations. You can google new yorks statute of limitations and see how long it is. Once the SOL is up the collector can not legally collect the debt, it is being referred to as past the limits of the statute of limitations.
If the judgement was placed you have thirty days to file for it to be vacated. Was you in court when the judgment was placed? If the SOL has passed you may be able to get the judgment revoked due to the SOL expiring. If you can not find New Yorks SOL let us know and we can look it up.
