I just received a summons about a debt that I supposedly have (from LVNV Funding). About 1995-1996 I was the victim of Identity theft and have been fighting ever since to have things removed, I successfully had over $20,000 removed, now this one shows up for close to $900. After reading these posting I am concerned about contacting these people. They did provide me with a local attorney's name to contact which I did leave a message for. I want proof in writing that this was me, I don't remember this at all, is this something I should do? I want to see my signature on a document because I can tell my own signature.

I don't blame you, you should be able to ask for proper debt validation and they have to provide it. If they give you any problem then you should contact your state attorney generals office, their attorney office and the federal trade commission for help with it. They have more bite than a normal everyday consumer.

thanks for your response. Since this was the first I heard of them trying to contact me, it concerned me. I went to my credit report and it showed that the account was opened in 1999 and written off 4/2006 as a bad debt. The papers I received today indicate that the account was opened in 10/2006 (I believe I was either still in Florida or enroute back to Nebraska during this timeframe), so I don't understand how an account was opened or reopened for that matter? If the information on your credit report is inaccurate, you should dispute it with the credit bureau through a dispute letter. However, you are saying that you have received a summons, so you must answer the summons. Then I think you should send a debt validation request to the creditor since it is an old debt. This should not have happened since you were already fighting an id theft. But didn’t you request the bureau to put an alarm so that the id theft could be avoided in future? Anyways, I think you should let the court know about this while sending a reply to the summons.
