aol are trying to collect £57.56 from me for an account i had with them in 2001 and i have moved house since then and they have just contacted me asking for the money.i closed the account as far as i know correctly back then with no debit of any kind.can they force me to pay!!somone rang me today asking for payment i replied b****ks because they could not tell me what it was for and the date can. any one advise on the debit if they can persue this?as it is 8 years old
Hello Dave, You may not have to pay this debt if the statute of limitations has expired on this debt. It should have even fallen off of your credit record. Here is what I would tell you to do. Send this company a debt validation letter by certified mail. Give them 30 days to respond. If they do not then they can not pursue this debt any longer. You can also send an SOL expiriy letter if your SOL has expired and a cease and desist letter. I would start with the validation letter first though.

As it is an 8 year old debt, the SOL for the debt must have expired, since in most states the open ended accounts expire within 5-6 years. Ideally it should have fallen off your report. However, under such circumstance, like Firey said, you must send a debt validation letter to the CA. See if they are able to verify your debt, which I do not think is possible.
Then send an SOL expiry letter along with any proof you have regarding paying off the debt and closing the account. Even after this, if they pursue, then you can file a complaint against the CA to the FTC or the SAG.
