I have received a summons in the mail for an alledged debt that is not reported by any of the three major credit bureaus. I have never received a letter from this collection agency stating that I owe them money. Had I received a letter I would have asked for validation of the debt. I can not find any information on this alleged debt. It looks like the original creditor was bought by several banks. I don't know what to do. HELP!!!!
Hi,
Have you checked your credit report thoroughly? I think you need to find out the address of the CA and send them a validation of debt letter. However, also remember to reply to the summons and state clearly that you have doubts regarding the ownership of the debt. You might also call the original creditor and talk to them regarding the matter.
Thanks, Justin. I have checked it thoroghly, there's nothing there. I wish I could call the original creditor. There were bought out many times and it doesn't seem like anyone can find my information. I am definitely going to file an answer, I'm thinking the CA won't have any information on the debt. I just want to know everything before going to court. I can't afford to have a judgement against me.
Hi,
I think you can also do one more thing. Write a cease and desist letter to the CA since you think that there is inadequate information on the debt. Even after this, if they proceed with the summons, you can meet them at the court and place your case nicely to the judge. You will get a fair chance to present your case at the court. So don't lose hope.
