I recieved a summons today and I'm not sure what to do. Its from Capital Ones attourney. I know I owe money and I want to pay, but there is no way I can pay the full amount, I need to make payments. Do I go to the courthouse it was filed and fill out a form, and then try to contact the company? I can't afford a lawyer. What type of written answer do I give?
Gettign an attorney is the best thing, but as you said you can afford you can probably handle it yoru self
Make sure to respodn to the summons with the time given, since this is now in the court, there is nothign much will happen if you call the credit card company. You would ahve recieved a letter which states what are the allegatiosn against you. Make sure to answr each one fo them. If you donto agree for any one of them make sure to write a small explination
You shoudl send a copy to th ecourt and also one copy to the attorney from the credit card company
After this appear in the cort the same you are suppose to and you will have option to argue your response

I understand your situation. When you have received a summons, you have to reply to it ASAP. There is no such sample letters for replying to summons. You will need to fill out a form at the clerk's office in the court which has served you the summons.
Soon after that, contact the company and try to make them understand your situation. You might also tell them about the amount you can pay and a payment plan which you have calculated. If the company agrees, then send a debt settlement agreement to them and send a copy of that to the court. Always send this through a certified mail so that you have the return receipt.
I would make sure the court does get a copy of this letter so that when you have fullfilled the debt settlement amount they will remove it. I am not sure if you could ask also for a pay for delete in this situation but it may not hurt to also ask for that. Most do not want to see the inside of a courtroom so they may be willing to work with you.
If he/she has got the summons then it is from the court.
