i filled an answer with the court and received a court date; i also request debt verification letter from CA;however i only received an interogation questions and settlement option for lower payment than balance. i really dont have time or money to go to court; if i choose to settle; do i still send the interogation answers? and do i send a copy to the court too. should i trust the CA to withdraw the case after i pay the debt?
thanks

who is the creditor if you don't mind? You can come to some kind of arrangement with them if you owe the debt. Once an agreement has come, they can not sue you unless you break the agreement. They will be entering into a contract/agreement with you.

which papers should i send with the settlement payment; do i still have to send the interogation answers to the court; or just the settlement aggreement and payment to the lawyer; do i send anything back to the court; or should i trust the lawyers of the CA to do so. i am not sure how to proceed. thanks

Hi,

Do not panic. You said you have already asked them to verify your debt. I think the CA has sent you the questionnaire to find out whether you will eligible to pay the debt using the lower payment plan. Based on your answers the CA might evaluate your situation. However, if you agree to pay the debt amount they are asking, then you need to send them a debt settlement agreement letter stating the terms, conditions and the amount both of you have decided on. If the CA agrees then you can send the court the papers showing their agreement to the amount of debt payable by you.

the debt settlement agreement letter is already included in the paper work that the CA sent with the interogation questions. the debt settlement agreement letter states 2 options of settlement; i will choose one and send the check to the CA and a copy of that letter to the court. however i need to know do i still fill the interogation questions at this time, eventhough i decided to settle the debt; or should i ignore those papers;
also, since the court sent me a court date for my answer; how do i cancel that, so i don't have to show up on that day, but i don't want it to count against me?
thanks
