Hello Everyone,
I have a debt collector suing me which is not the original creditor. I was served with the summons which were left at my parents doorstep, this is the address I use to get all my mails. I have not been in the country for the past two years and am still out. I have gone through the forum and understand that I must reply otherwise they will get a default judgment against me. How do I reply to the summons from out of the country. I have been server in the State of California.
Hi churmana
This might be complicated. The orders or judgment in your case might not be enforceable in another country.
Churmana, when did you receive the summon? Is the date of summon passed? If you cannot appear in court, there will likely be a default judgment against you. Any savings account that you may have there may be garnished.
What you can do is, when you have a plan to go back to California, you may send a motion to vacate the judgment. Till then there is not much that you can do. If you are eager, then maybe you could ask an attorney to represent you in court and do the needful now.
Hi Carol,
I still have around 10 days remaining to answer the summons. But how can I, is it possible to do it through mail? I can get my father to fill out the form and send it in. But would that show the court that I am in the country?
