My mother received a summons over a month ago for a credit debt, but she had no idea what it was because she doesn't read or speak English. I came home to visit for the summer and read and explained what the documents were to her and then I noticed that it has been passed 30 days since she received the summons and she did not file a written response. Is there something that we can do at this point that can help her case in any way??
Hi DesparateForAdvice
It is likely that the creditor will have gotten a default judgment. However, you could try and approach the agency that has your debt and give them a good explanation of why the summon was not answered and make a request to set aside judgment. You must have enough evidence for not answering a summon because this is serious.
