I have a negative account in my credit report. This is due to a cleaning charge by the ($1000) with apartment management (name A), when I moved out the apartment in the year 2006. It is not a genuine charge. I denied to pay. The apartment owner contacted a CA (Name B). B contacted me regarding this charge. I disputed the charge in writing to both apartment owner and the CA-B, with in 30 days of their initial letter. After a year another CA (name C) contacted me for the same account. I again sent a dispute letter to both B and C, and requested them not to contact me unless they have new evidence. After that (in year 2007) no one contacted me.

Now I want to clean up my credit report. My credit report shows the name of the CA-B in the negative item. I intend to write a pay for delete letter to CA. Is it a good idea? Will it help or hurt? If so, to which CA, I should send the letter? Am I reqired to send the “pay for delete” letter to a CA “B” or “C” or the apartment owner “A”?

Does SOL has any effect on my new initiation?

You could dispute the claim and as you do that the Credit Bureau is supposed to contact your creditor and request for a validation of the debt. Once you dispute the payment the CB must provide proof of the entry within 30 days unless there i an an exception.

The creditor must respond to the Credit Bureau in time with the relevant proof. If he can't then the false information on your report must be deleted. The FCRA (Fair Credit Reporting Act) states that any information that cannot be verified must be deleted from the records.

Do you have any proof that you disputed the charge the first time. They would have had 30 days to validate the debt. If they did not you could have had it removed from your report. You should be sure when you are asking for debt validation to send all letters by certified mail. This gives you proof that you did actually request. If they do not validate the debt then it also goes to court it will keep them from winning since they violated your rights per the fair debt collection act.
