i have a court date for a warrant in debt in two days in another city. i cant be there and wonder what happens if i am found guilty. i dont have any assets and am trying to file for bankruptcy. i do have a car that i make payments on. will they take my car or garnish my wages?
They will not take your car but not showing up really is the worst decision you can make. They will get a default verdict against you and can very well (and probaly will) attach your wages and your bank account.
By going to the hearing you give yourself a chance to be heard. You could inform the judge you in the process of filing for bankruptsy and he may wait to see if that goes through. There are a number of things that could happen but by not going you are only going to end up with the worse case scenario..one that will not be in your best interests.
Your first problem is, not to appearing in court against your debt. But it would be shamed for your credit in society.
Your second problem is feeling guilty against your warrant. It is also shamed for yourself.
Your third problem is giving car against your debts it is shamed for your education and knowledge next to court . so avoiding your shamefulness, you have to face for this circumstances by appearing, confidently and giving reliance about your debts.
So I advice you to appearing in court with confident by selling your car personally and giving yours impression on court by asking for some period to repayment your debts. Court will give you some time to recover the money and that's why you will paid your debts in time of court given to you. Mean while you will get three benefit as confident,non guiltiness,and debt free life.
