I am tired of attending collection calls of somebody of who has my name. A collection agency calls me everyday for debts on Amex cards, I have never had. I have told them I have no accounts of the account number they have mentioned. Last night when I was out they called, my mother answered and they were rude. I have a perfect credit and hate to bother my parents for no reason at all. Does anyone have a letter to send to them? I want to sue them in court but want to avoid it because of the fees involved. So if a letter would be enough I would like to go ahead with that.
Hi Wigfield,
You should send the collection agency a "Cease and Desist Letter". You will find a sample "Cease and Desist Letter" in the Letters of Credit section.
In case the CA continues to call you for debts that do not belong to you, sue them in a small claims court. You can tell the court that they are violating the FDCPA. If you win, you will be able to recover the court fees.
