If a judge throws out an eviction, and says that I don't owe this company anything, then the company hires a lawyer, and he reports it as debt to the cb's after being told the judge's ruling, would I be able to sue for liable?
You can send a debt validation letter to the creditor and the creditor is required to validate the debt within 30 days from the date of receipt of your letter. If he fails to do so, you can dispute the debt with the credit bureaus. You can also file a complaint with the Federal Trade Commission and the FTC will take appropriate steps against the creditor.
I would fiel with the FTC. This is usually the quickest way. Also send the dv letter. Do you have any court documents showing the eviction was thrown out? If so I would let the FTC know that and send along a copy to the credit bureaus. You also have one more thing you can doa nd that is to call your states Atty. Generals Office. You can find their number on the state website.
