Do I file jointly or seperatley

Me and my wife are currently having problems and not living together, we also have to kids. What affect does this have on filing my taxes.

Hello.......I want to just tell you my 'personal' experience, with an issue like this. I seperated from my ( NOW) EX almost 9 years ago. We've lived in different households, since then. I have a child, too. Because you live in seperate places, it would be 'beneficial' to you to file your taxes Married: Filing Serperately. Can you tell me who 'claims' your children? If you have two kids, YOU can 'claim' one and your wife can 'claim' one. The only thing you have to have proof on is your NEW address, etc. Hope this helps.

If you have already filed you taxes jointly then its OK, but if you have not till now, you should file it separately. This is because, if you get any benefits from further economic stimulus payment, it can directly be credited into your bank account and will avoid confusion on distributing the amount between you and your EX, as would happen if you file it jointly.

Is there any custody arrangements set up? Does your wife work and file taxes? Why I am asking is if she has full custody of the child or children and files a tax return then she has the first right to claim any dependants since she has full custody. You both can not claim the same child. Now if you are the only working parent you can claim any children because no one else will have claimed them. I hope this helps....ps...file seperately if you do not think you will work out your problems.

FIREYONE is right..you cannot file for the SAME children, however.....if you have 2 kids, your wife can file for one and you can file for one. And...FIREYONE has a good point, too. If your wife has 'primary' custody, the choice is up to her whether you can file for either child. My EX do it this way....this is MY decision ( to 'keep the peace' sort to speak). My EX always seems to 'pull something' during Tax time. Thsi si what we do: I 'claim' the Excemption on my child and my Ex 'claims' the EIC on my child. We have 1 child. THIS way we both 'break even'.

i have already submitted taxes with the wife on it and i forgot to add her W2 too it can the wife still submitt her W2 too and file on her behalf?

You can call up Internal Revenue service at the following number 1-800-829-1040 between 7 am and 10 pm between Monday and Friday.
You can also wait for IRS to contact you. If you have not submitted the w2 form of your wife, you need not worry because the IRS will send you a notice telling you that you have not submitted the form. On getting such a notice, attach a copy of the form with the response page and send it to the IRS by certified mail.

I agree with Mary. Such instances are frequent, and so IRS has set up a system by which a notice will be send to you asking you for the W2 form. You can contact IRS for the same, but I think that they will ask you to wait for the notice.
