If an original creditor doesn't have my information on file anymore, how can I verify the Date Of Last Activity? I'm looking at 2 of my CRs from last year, and the dates when the accounts are supposed to drop-off are different by a few months!!

The only the information that can (effectively) be used to dispute information with one bureau or the other is information from the original creditor or successive third-parties collectors.

The bureaus generally take the stance that they are the "messenger", and thus, the information they report is simply a second-hand accounting of the info... NOT a true accounting of it...

For example, if a law suit were to be filed against a company with evidence of a misreporting of information from the original creditor, but you can't sue a debt collector using the information from a credit reporting agency as evidence of the facts.

If the original creditor has sold off the debt to the collection agency, then he might not have in record the details of the debt anymore. In that case you need to contact the collection agency to whom it has been sold. Now, if the listings are about to expire, I think that your might have passed the SOL on the debt. If you have any of the credit report from where the debts have been removed, you can send a copy of that report to the other two bureaus asking them to remove the listing.

I did answer you here Key, I had the same thing on my report and there was a couple different fall off dates. You can wait until the first fall off date and then either wait out the other one or dispute it as absolete with the credit agencies. Is there any chance you have any old credit report laying around. It would be easier looking at one fo those then calling the debt collector. They are not known to be the most honest people. They could give you misguided information.

Thank You for your help! I did found letters of collections from the same CA and for some reason they have different amounts.. and the amounts are different than the credit report.. then I found a report that i got from a mortgage broker back in 2006 and it all looks different! not only that but in one of the accounts the DOLA says 12/2000 and that debt is still on my CR!! I really want to clear my CR on my own because a credit repair agency is charging me a fortune to do this.. I just dont know how to go about the CA, and I mean how to ask for information from them.. should I go with the bureaus first? thanks again for your help!! =)

Hi, keylamoon Yes it should have fell off your report by now. I believe that as long as you have not made any oayments sinece 2000 you should dipute the marks on your credit through the credit bureaus. Good luck.

OnTWO of my CR's, I have the DOLA different, too. However..these items will be 'falling off' soon, So, I'll probably just leave them alone.

Hi Key
The amounts in the credit report and the collection letter may be different because of the interest rate and the late fees. To know the details about the debt, you need to send a debt validation letter to the CA within 30 days of your receipt of the collection letters. If you want to remove the negatives from your report as they have crossed the seven year time frame, just send dispute letters to the bureaus. The bureaus will verify it with the creditor and remove them.

Can a dv letter be sent well after the first notice was sent, or would it be futile at that point? Also, can a debt be charged off & transferred/sold? The CA isn't listed...
Also, is medical debt treated differently than other debt? If I paid something off but it shows up on my report as having been sold to "Factoring Company Account-debt buyer", do I contact the reporting agencies to clear or the "buyer" of the loan? Sorry....ended up asking about much more than dv letter. Thanks for the help!

Hi thomas,

Don't you have your last payment receipt? I think you can try finding that.

bmbjmck, you will have to check her credit report for the date of last activity on the account.

Thanks,

Aaron
