Not real handy in thbis dept but I know if you do not reply within so many days I think 20 you will automatically lose cause the judgemnet will go against you. Someone will be able to better answer this question for you but they will mkoe than likely need to know if this is the original creditor or a debt collector. Try to post that info.

You should first file a response to the summon within 30 days of receipt of the summon at the court from where the suit has been filed against you and send copy by certified mail to the company which has filed the suit against you. However if you do not file a response to the summon, the company that has filed a lawsuit against you may get a default judgment against you and you may need to pay the entire debt outstanding in addition to the court fees and other costs.

You said that you have received a summon on 10th April 08. This means that one month has already expired from the date you have received the summon and so the time period for filing a response to the summon has already expired. Now, you should immediately contact the creditor or the collection agency and come to a repayment agreement to pay off the debt because now the creditor can bring a default judgment against you to recover the debt.
Anthiny I believe he posted that he recieved a summons on Oct. $ 2008 so he can still file a response.
Just follow what Justin tells you to do. You have to get a response in and soon.
