help w/palisdades

I pulled my credit report and see that Palisades is showing a debit that I owe for an AT&T from 1998 which I had rectified long ago. This bill was originaly incurred in Massachusetts but I have lived in Florida for 7 years. My son forwarded me a notice from an Atty for Palisades taking me to court to garnish my wages, however the company they are trying to garnish from, I was laid off from. I have never received anything regarding this debt and I would like to know how I can go about rectifying this debt. Should I call Palisades? How do I fix this and find out about this debt and if it is legitimate? Please, I need some advice...

The Statute of Limitation in Massachuetts is 6 years and since the debt has already passed six years, Palisades cannot take you to the court to collect the debt, because you are no longer liable for the debt. You can send a DV letter to Palisades under certified mail and I am sure that they will not be able to validate it. However, since the SOL for the debt has already expired, never pay any amount to Palisades for the debt because if you make any payment towards the debt, the Statute of Limitation will again restart and Palisades will be able to take you to the court and bring judgments against you to recover the entire debt. So you should not go by their threatening and make mistake by making a payment towards the debt.

I agree with Anthony. Since the debt is already 7 years old, you need not pay it off as the SOL has already expired. Palisades need to produce garnishment order to your employer within seven days of the payday every month if they want to garnish your wages and since SOL has already expired, Palisades cannot bring judgment against you to garnish your wages. However, if you want, you can send a debt validation letter by certified mail to Palisades to find out whether the debt is legitimate or not. If they validate the debt, then the debt is legitimate else not. However, even if they validate the debt, you need not pay it if SOL has expired.
